What personal information BhavaniAI Inc. collects, why we collect it, who sees it, how long we keep it and how you get it back or get it deleted. Written to be read, not to be skimmed past.

Privacy at a glance

This is the short, plain-English version. The full policy is below it, and the full policy is the one that governs. If the two ever seem to disagree, the full policy wins and we will fix the summary.

The things most people want to know

Who we are. BhavaniAI Inc., an industrial staffing company at 50 Mississauga Valley Blvd, Mississauga, Ontario L5A 3S2.

What we collect. Your name, email, phone, city, the kind of work you want or the staff you need, and whatever you choose to type into a form or an email. If you send a resume, we hold the resume.

Why. To answer you, to match people to work, and to keep the records the law tells us to keep. Nothing else.

Who we share it with. The client company we are putting you forward to — and we tell you the company name before we send anything. Plus a small number of service providers, like the company that hosts this website, under contract.

We never sell your information. Not to advertisers, not to data brokers, not to anyone. There is no list you end up on.

Your choices. You can ask to see what we hold, correct it, delete it, get a copy of it, or withdraw your consent. Email us and we act within 30 days.

How long we keep it. Applicant information for 12 months by default. 24 months only if you tick the box asking us to. Some records the Ontario Employment Standards Act requires us to keep for 3 years.

Cookies. This site sets no tracking cookies. Analytics stay switched off unless you turn them on. No fingerprinting, no super cookies, no zombie cookies.

We never charge workers a fee, for anything, ever — and we never ask for your Social Insurance Number or your banking details through this website.

Accessibility. Want this policy in large print, in plain language, by email, or read aloud to you over the phone? Ask, and we arrange it at no cost. Same for making any privacy request — see our Accessibility page.

If we get it wrong. Tell us first: info@bhavaniai.ca. If we do not fix it, complain to the Office of the Privacy Commissioner of Canada — 1‑800‑282‑1376.

Honest note: we are a new company

BhavaniAI Inc. has not placed anyone yet. Our Ontario temporary help agency licence application is in progress and we are not operating as an agency until the Ministry issues it. This policy describes how we are building the business and how we handle the information we hold right now — mostly enquiries and launch-list signups.

This policy will be reviewed by legal counsel before operations begin, and updated if counsel tells us to change it. We would rather publish something honest and specific now than a page of borrowed boilerplate.

1. Who we are and how to reach us

BhavaniAI Inc. is an industrial staffing company based in Mississauga, Ontario. We staff warehousing and distribution, manufacturing and production, food and beverage production, transportation and logistics, and general labour roles. In this policy, "we", "us" and "our" mean BhavaniAI Inc.

We are responsible for the personal information in our custody and control, including information we hand to a service provider to process on our behalf. That is the first principle in Canada's federal privacy law, the Personal Information Protection and Electronic Documents Act (PIPEDA), and it is the one everything else rests on.

Our Privacy Officer

One person is accountable for privacy at BhavaniAI Inc. Until we name someone else in writing, that role sits with the officer holding the highest authority in the company. Write to them here and mark it Attention: Privacy Officer:

2. What personal information we collect

We collect only what we actually need for the purpose we are collecting it for. If a field on a form is not marked required, you can leave it blank and we will still respond.

People who visit this website

We do not run analytics on this site today, and we do not build visitor profiles. Our hosting provider keeps standard server logs — IP address, browser type, the page requested and the time — for security and to keep the site running. We do not use those logs to identify individual visitors.

People who contact us

Your name, email address, phone number, company if you give one, and the content of your message. If you email us directly, we hold the email.

People looking for work

Name, email, phone, the city or area you can work in, the kind of work and shifts you are looking for, any certifications you tell us about (for example a forklift licence or a driver's abstract class), whether you are legally entitled to work in Canada, and your resume if you send one.

We do not ask for and do not want: your Social Insurance Number, banking or payroll details, your date of birth, your immigration document numbers, your health information, or anything about your family. We also never ask for "Canadian experience" — that is a prohibited requirement in Ontario job postings and we would not ask for it anyway.

Contacts at client companies

Business contact information: name, job title, company, work email, work phone, site address, and the details of the staffing request. Under PIPEDA, business contact information collected and used to communicate with someone about their job is treated differently from personal information — but we look after it the same way regardless.

3. What we will never ask you for

We never charge workers a fee, for anything, ever. Not to register, not to apply, not to be placed, not for a resume, not for training, not for a uniform, not for a ride. Ontario's Employment Standards Act, section 74.8, prohibits a temporary help agency from charging assignment employees these fees. We agree with the law and we would not do it anyway.

We never ask for your Social Insurance Number or your banking details through this website. Not on a form, not by email, not by text. If you are hired and put on payroll, that information is collected later, in person or through a secure payroll process — never through a web form or a message.

If anyone contacts you claiming to be from BhavaniAI Inc. and asks for money, for your SIN, or for your bank account so you can "get started", it is not us. Stop, and email info@bhavaniai.ca so we can warn other people. You can also call the Ministry of Labour Employment Standards Information Centre at 1-800-531-5551.

4. Why we collect it

We identify the purpose before or at the moment we collect anything, which is why every form on this site says what it is for. Our purposes are:

  • To answer you. If you send an enquiry, we need a way to reply and enough detail to reply usefully.
  • To match people to work. Your location, shift availability, certifications and the type of work you want are the whole basis of a sensible match. Sending someone to a job 90 minutes away on a shift they cannot work helps nobody.
  • To put a candidate forward to a client company — with your knowledge, and after we have told you which company.
  • To run the business. Quoting, invoicing, scheduling, and keeping in contact with client companies.
  • To meet legal obligations. Employment standards record-keeping, health and safety obligations, tax records, and responding to a lawful order.
  • To keep people safe. Checking that a certification is real and current before someone is put on equipment.

If we ever want to use information for a new purpose that is not on this list, we will ask you first. We do not quietly repurpose data.

We collect, use and disclose personal information with your knowledge and consent, except where the law allows or requires otherwise — for example, responding to a court order or a lawful request from a regulator.

How we take consent depends on how sensitive the information is:

  • Express consent — a tick box you have to check yourself — for keeping your details on file, for sending your information to a client company, and for anything optional such as job alerts. Nothing is pre-ticked.
  • Implied consent for the obvious: if you email us a question, you are plainly consenting to us using your email address to answer it.

Consent must be meaningful, so we do not bury it. We do not make consent to an optional thing a condition of an essential thing. You will never have to agree to marketing to be considered for work.

Withdrawing consent

You can withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Email info@bhavaniai.ca and say what you want stopped. We will confirm within 30 days, tell you plainly what the consequence is — for example, we cannot consider you for a role if we cannot hold your details — and act on it. There is no penalty and no argument.

Where the law requires us to keep a record for a set period (see section 8), withdrawing consent stops us using the information, but we may still have to retain the record itself until the period ends.

6. Who we share it with, and where it is stored

Client companies

Putting people forward to client companies is the point of a staffing agency, so this is the disclosure that matters most to you.

We tell you the name of the company before we send them anything. You will always know who is looking at your resume, where the site is, what the role is and what it pays. If you say no to a particular company, that is the end of it, and it does not affect anything else we put you forward for.

We send the client only what they need to make a hiring decision: your name, contact details, relevant experience, relevant certifications and availability. We do not pass on side comments, notes about your personal circumstances, or anything you told us in confidence.

Service providers

We use a small number of providers to run the business. They may only use the information to do the job we hired them for, they may not use it for their own purposes, and they are bound by contract and by a comparable level of protection to our own. Here is the actual list as of the date at the top of this page:

We do not use an analytics provider, an advertising network, a chat widget, a tracking pixel or a customer data platform. If we add one, this table changes and the change is announced in section 17.

Information stored outside Canada

Some of those providers store data outside Canada, mainly in the United States. This matters, so we will say it plainly: while your information is in another country, it is subject to that country's laws, and it may be accessible to the courts, law enforcement and national security authorities of that country. We cannot promise otherwise, and no Canadian company honestly can.

What we can do is limit what leaves: we keep the amount of personal information handled by foreign providers as small as the job allows, and we use contractual protections. If you would prefer to deal with us entirely offline — by phone or on paper — email or call us and we will set that up.

Other disclosures

  • When the law requires it. A subpoena, warrant, court order, or a lawful demand from a regulator such as the Ministry of Labour, Immigration, Training and Skills Development. We check that the demand is valid before we hand anything over.
  • To protect someone. Where there is an imminent risk to a person's health or safety.
  • Professional advisers. Our lawyers, accountants and insurers, where necessary, under a duty of confidentiality.
  • A sale or merger of the business. If BhavaniAI Inc. is ever sold or merged, personal information may transfer as part of the transaction. It would be limited to what is necessary, the buyer would be bound to the purposes described here, and we would post notice on this page.

7. We never sell personal information

We do not sell, rent, trade, licence or barter personal information. Not resumes, not contact lists, not "anonymised" behavioural data, not to advertisers, not to data brokers, not to other agencies, not to lead generators. There is no arrangement under which anybody pays us for access to people. There never will be.

We are paid by the companies that need workers. That is the entire business model.

8. How long we keep it

We keep personal information only as long as it is needed for the purpose it was collected for, or as long as the law requires — whichever is longer. Then we destroy it securely: digital files deleted, paper shredded.

If we use personal information to make a decision that directly affects you, we keep that information long enough for you to be able to ask us about the decision and challenge it.

You do not have to wait for a retention period to run out. Ask us to delete your information and, unless a law forces us to keep the record, we will.

9. Keeping your information accurate

Information that is wrong causes real damage in staffing: a lapsed certification recorded as current, a phone number one digit out, a city that means a two-hour commute. We keep personal information as accurate, complete and up to date as is necessary for the purposes it is used for, and no more — we do not go hunting for extra detail about you in order to "enrich" a record.

We do not buy data about you from third parties, and we do not scrape it. What we hold is what you gave us.

If something we hold is wrong, tell us and we will correct it. Where the correction matters, we will pass it to anyone we disclosed the old information to in the previous year. If we disagree about a correction, we record your position on the file and it travels with the record.

10. How we protect it

We protect personal information with safeguards appropriate to how sensitive it is. A resume gets more protection than a request for a brochure.

  • Technical. This whole site is served over HTTPS. Accounts holding personal information use multi-factor authentication and strong, unique passwords. Devices are encrypted and locked.
  • Organizational. Access is on a need-to-know basis — the fewest people who can do the job. Everyone who handles personal information is trained on this policy and bound to confidentiality.
  • Physical. Paper files, if any, are locked. Nothing with personal information is left on a desk, in a vehicle, or in a recycling bin.
  • Disposal. Secure deletion and shredding, not a bin.

No system is perfectly secure, and we are not going to claim ours is. We do not hold any security certification and we do not claim one.

If there is a breach

If a breach of our security safeguards creates a real risk of significant harm to you, we will report it to the Office of the Privacy Commissioner of Canada and notify you as soon as feasible, with what happened, what information was involved, what we are doing about it and what you can do to protect yourself. We keep a record of every breach for 24 months, whether or not it was reportable.

11. Your rights, and how to use them

These are your rights over the information we hold about you. To use any of them, email info@bhavaniai.ca with "Privacy request" in the subject line, or call or write to us using the details in section 1.

  • Access. Ask us what personal information we hold about you, how we are using it, and who we have disclosed it to. We will tell you.
  • Correction. Ask us to fix anything inaccurate or incomplete.
  • Deletion. Ask us to delete what we hold. We will, unless a law requires us to keep the record — in which case we will tell you which law and for how long.
  • Withdraw consent. At any time, as set out in section 5.
  • Portability. Ask for a copy of the information you gave us in a structured, commonly used electronic format — a machine-readable file you can take somewhere else.
  • An explanation. Ask us why we are asking for a piece of information before you give it. Every time.

Our commitment: we respond within 30 days of receiving a request. Access requests are free. If a request is unusually large and would carry a real cost, we will tell you the estimated cost first and you can decide whether to go ahead — we will not surprise you with a bill.

We will ask you to confirm your identity before we release information, because handing your file to the wrong person is the failure that matters most. If we refuse a request in whole or in part, we will tell you in writing, explain why, and tell you how to complain.

12. Cookies, analytics and what this website stores

Short version: this site sets no tracking cookies at all. There is no analytics running on it today, no advertising pixel, no social media tracker, no session recorder and no heat map.

The only thing we store on your device is a single entry in your browser's local storage, named bhavaniai-cookie-choice. It records whether you chose "Allow analytics" or "Essential only" in the cookie banner, so we do not keep asking you. It contains no identifier and it is not sent to us or to anyone else. Clearing your browser data removes it and the banner will simply ask again.

Analytics stay off by default. If we ever add an analytics tool, it will load only for visitors who have chosen "Allow analytics", and this page will be updated to name the tool before it goes live. Refusing analytics never limits your access to any part of this site.

What we do not do, and will not do:

  • No device or browser fingerprinting.
  • No Flash cookies, ETags, HSTS tokens or other "super cookie" techniques.
  • No "zombie cookies" that respawn after you delete them.
  • No cross-site tracking, and no selling of behavioural data — see section 7.

One external request does happen on every page: your browser fetches the Manrope typeface from Google Fonts, which means Google receives your IP address. It is listed in the table in section 6 so that you know about it.

13. Automated decisions and artificial intelligence

Our name has "AI" in it, so this deserves a straight answer. We do not use automated decision-making or AI screening to accept or reject anyone. No algorithm ranks your resume. No system filters you out before a person has looked. A human reviews every application and a human makes every call.

Ontario's job-posting rules require covered employers to disclose in a publicly advertised job posting whether artificial intelligence is used to screen, assess or select applicants. Our answer will be "no", and it will say so on the posting.

If that ever changes, we will update this page first, say exactly what the system does, and tell you before it is used on your application — along with your right to ask for the reasons behind a decision and to have a person review it.

14. Children

This website and our services are meant for adults looking for industrial work and for people hiring them. We do not knowingly collect personal information from anyone under 16. Please do not send us information about a child.

If we learn that we have collected information from someone under 16 without a parent's or guardian's consent, we delete it. If you believe that has happened, email info@bhavaniai.ca and we will deal with it promptly.

15. If you are in Quebec

We operate in Ontario today. If we hold personal information about someone in Quebec, Quebec's Act respecting the protection of personal information in the private sector — the law usually called Law 25 — applies to us, and we have built this policy so that we are ready for it rather than scrambling later.

Specifically:

  • A named person is accountable. Our Privacy Officer is identified in section 1, with contact details.
  • Confidentiality by default. Analytics and any non-essential technology are off unless you switch them on. That is the default setting, not a preference you have to hunt for.
  • Transparency about technology. We tell you when a technology on this site collects anything — including the Google Fonts request in section 12.
  • Portability. The right to receive your information in a structured, commonly used technological format is in section 11.
  • Automated decisions. We do not make them. See section 13.
  • Before information leaves Quebec, Law 25 requires a privacy impact assessment. We will complete one before we transfer personal information about a Quebec resident outside the province.
  • Confidentiality incidents are logged in a register and reported to the Commission d'accès à l'information where the risk of serious injury requires it.

If you are in Quebec and you are not satisfied with how we handled your request, you can contact the Commission d'accès à l'information du Québec at cai.gouv.qc.ca.

17. Changes to this policy

We will change this policy when the business changes — when we add a service provider, when the licence is issued and we start placing people, or when counsel tells us to. The "Last updated" date at the top of this page always reflects the current version.

If a change is significant — a new purpose, a new category of disclosure, a new analytics tool, a longer retention period — we will say so clearly at the top of this page for at least 60 days, and where the change materially affects information we already hold about you, we will contact you and, where consent is required, ask for it again. We do not apply a new purpose retroactively to information you gave us under the old one.

We keep previous versions of this policy. Ask us for one and we will send it.

18. How to complain

If you think we have mishandled your personal information, or you are unhappy with how we answered a privacy request, we want to hear it directly. A complaint costs you nothing and it does not affect how we treat you or whether we put you forward for work.

We acknowledge every complaint within 5 business days and investigate every one, even where it turns out we did nothing wrong. We will give you a written answer, tell you what we found, and tell you what we changed. If we were wrong, we will say so.

Step 2 — Go to the regulator

If we have not resolved it, take it to the Office of the Privacy Commissioner of Canada. It is independent of us, and complaining to it is free.

The OPC normally asks you to raise the issue with the organization first, which is why step 1 exists. If you are in Quebec, see section 15 for the Commission d'accès à l'information.

Complaints about pay, hours, fees charged by an agency, or other employment standards issues go to the Ministry of Labour, Immigration, Training and Skills Development — Employment Standards Information Centre, 1-800-531-5551.
